First Do No Harm

As a physician in the practice of pediatric and adolescent medicine,
I have evaluated and treated over 8,000 children with Lyme and other
tick-bourne diseases from every state in America, from most provinces
in Canada, from countries in South America, and from every continent
abroad. No other pediatrician in the world has my experience in
evaluating and treating these diseases.

My office receives 5-10 inquiries per day from parents who are
desperate to obtain an adequate evaluation of their children with
Lyme and other tick-bourne diseases. Due to my very busy 10 hour per
day, 6-7 day per week Lyme practice, there is a 5-6 month delay
between office contact and an actual office visit. In order to do no
harm by delaying evaluation and treatment, a history and lab test are
obtained. Treatment is initiated prior to an office visit if a
probable diagnosis can be made. Most of these children have already
suffered from a delay in diagnosis and/or inadequate treatment of
their tick-bourne disease.

This is the background that led me to evaluate and treat two children
from Nevada prior to my seeing them. My diagnosis of probable
gestational Lyme disease and tick acquired Lyme disease was made on
the basis of the history presented by their mother and my over 30
years of treating children with tick-bourne diseases. I have been
reported to the Connecticut licensing board and have been charged
with making the diagnosis of Lyme disease and initiating antibiotic
treatment prior to examining them in my office and therefore am in
violation of the "usual and customary standard of medical care".

I have been offered the opportunity to have these charges dropped by
retiring and surrendering my license to practice medicine in the
state of Connecticut or I can appear before a panel of the
Connecticut Medical Examining Board to include Martin Harwin, M.D. (a
retired pediatrician) and Eugene Shapiro, M.D. (Yale-New Haven
Hospital) for a formal hearing to take place in late January, 2006.

I do not intend to retire because I still have a firm calling and
commitment to continue to help children with Lyme and other tick-
bourne diseases. So as not to go before the board unarmed, my

Hi folks,
A legal defense fund has now been set up for Dr.
Charles Ray Jones.

As most of you are probably aware, Dr. Jones has been
charged with unprofessional conduct by the Connecticut
state medical board, and a hearing has been set for
January 26th. The charges were initiated by an
estranged spouse in a custody dispute.

Dr. Jones has chosen a new attorney, Elliot Pollock,
with impressive experience in Connecticut state
medical board issues. This attorney used to serve on
the medical board and has successfully handled another
Lyme case before the board.

Because of the urgency of this case, Mr. Pollock has
graciously agreed to begin work now with the
understanding that we will raise the initial retainer
of $25,000 as soon as possible. Since January 26th
is only a few weeks away, he will try to have the
hearing date postponed to give him
more time to prepare an effective defense. However,
we do not know if this request will be granted.

For those who are new to Lyme disease, Dr. Charles Ray
Jones is, for all intents and purposes , the ONLY Lyme
literate pediatrician in the country.

He has saved thousands of children from spending the
rest of their lives in suffering and disability.

Hello from Dr. B.

As most of you know by now, Dr. Charles Ray Jones is fighting a battle with his state health department, similar to the one I fought several years ago. At stake is the ability of literally thousands of Lyme and other patients to receive the kind of care we all know is needed. He risks losing his license and potential monetary damages! His opponents are the usual ivory tower types, who all would wish that we would just go away, and accept their prescriptions for Prozac and Xanax and try to “get a life”.

Dr. Jones is THE most important person in Lyme right now, as he is considered to be the number one Lyme literate pediatrician in the world! Obviously, if our opponents can quiet him, then we all will once again be in danger of not being able to get diagnosed or treated by ANY physician, pediatric and adult, out of fear that the witch hunt will spread.

All of our forces have mobilized to support Dr. Jones and what he represents. I appeal to you now to support Dr. Jones in his defense fund.

When I was under attack, contributions to my defense fund and the heartfelt letters of support that accompanied them provided an indescribable moral boost to me. You see, in this type of a battle, the one under attack must keep spirits high and optimism strong and steady, or you lose faith in the battle and in yourself. Because of the huge amount of work and time involved in preparing for and in defending the case, having tremendous amounts of stamina is vital. I look back now, and I honestly can’t imagine how I was able to endure it all. My only answer is that I survived (physically as well as politically) thanks to the outpouring of love, support and prayers I got from everyone. A huge part of that included also the financial support, because going totally broke and potentially losing your house and your life savings can add enormous amounts of additional stress to the whole situation, making you more likely to just give up.

I ask all of you now to support Dr. Jones with at least as much warmth and generosity as you provided to me when I was under attack. He is a good man, a superlative scientist and clinician, and has been the savior of literally thousands of children (and their parents too). I ask that you also be creative to maximize the results- fund raisers, yard sales, cigarette money, etc. in addition to any extra money you can find.

The outpouring of support from everyone has been
wonderful! I am truly appreciative and lucky to have
the support of this community at a time when I need
it most. I am also grateful to all of those who have
sent messages, encouraging , supportive letters and
contributions toward the funding of my case. I know
that these efforts are driven by concern for me, and
they have touched me deeply.

However, it does seem like it would be best to put
one person in charge of all communication now, to
avoid confusion. This will insure that the
information you get is accurate and consistent, and
keep everyone focused on how you can help.

the beginning of Dr. Jones' hearing before the
medical board, but it has not yet been set. At this
point, it is expected to be some time at the end of
March. We should have the exact date soon, and I'll
let you know as soon as we do.

The legal team has been working very hard to prepare

I just wanted to briefly update you on my legal
defense situation.
I am extremely confident in my lead defense counselor
Elliott Pollack, Esq and co-counselor Lorraine
Johnson, Esq, who are diligently collecting relevant
information with Dr. Marra and me for the defense.

This case is complex with many facets, and requires
considerable time for appropriate preparation. . The
hearings are scheduled to begin sometime in March,
2006 and will proceed well into the summer months.

4) A SHORT PROGRESS REPORT ON WHAT THE LEGAL TEAM HAS
BEEN DOING TO THIS POINT:
a) The defense team has filed an answer to the charges
against Dr. Jones.

b) They have filed a motion to depose Eugene Shapiro ,
who is the
"expert witness" in the case against Dr.
Jones.

c) They have asserted that the standard of review for
medical board casesshould be "clear and convincing
evidence". The medical board has taken the position
that the standard should be "substantial evidence",
which is a much lower threshold of proof. This issue
is an important issue nationwide.

To put it in context, criminals are afforded a higher
standard of proof (beyond a reasonable doubt) than
physicians with medical boards. In simple
fairness,medical boards should be required to have
"clear and convincing" evidence before taking away a
doctor's license.

One week until the first hearing in Dr. Jones case.

Money into his legal defense fund continues to trickle
in much too slowly.

So please give whatever you are able to give. Dr.
Jones is, for all intents and purposes, the only lyme
literate pediatrician in the country.

He is also one in a long list of LLMD´s who have been
brought before state medical disciplinary boards in an
attempt to revoke their medical licenses.

If you, or anyone in your family, have Lyme disease,
this battle is yours.

What´s at stake in all these cases against our LLMD´s
is our right to the medical care that helps us.

The Infectious Disease Society of America continues to
fight against any substantial treatment for Lyme
disease. They continue to have the support of
insurance companies who would prefer to pay for only a
couple of weeks of treatment.

The only protection we have in the medical world are
the physicians who believe that chronic Lyme disease
exists and often needs extended treatment. Dr. Jones
is one of the most courageous and dedicated of these
doctors.

Please give whatever you are able to give. I know that
being broke is a common side effect of Lyme disease,
but this is a situation which requires help from all
of us if we are to continue to get treated.

If you have postponed contributing in order to see
whether it is absolutely necessary, then the time has
come!

Hi folks,
The next hearing in Dr. Jones' case will be held on
May 25th at the Legislative Office Building , Room
1-B, Capitol Avenue in Hartford, Ct.

It's ESSENTIAL that people maintain the same quiet and
respectful demeanor that they did at the last hearing.
Anything else could reflect badly on Dr. Jones and
hurt his case. (Of course, you can always sit quietly
and respectfully while wearing a green ribbon.)

The hearing room will only hold 59 people ,so we are
asking people to let us know in advance if you plan to
attend the hearing to support Dr. J.

Thank you all again for the support you have given
me. These past few months have been very difficult,
but all the signs of caring and appreciation from
Lyme patients have kept me going.

As for the May 25th hearing of my case, it is true
that I do want people to attend. But I have asked
Ellen Lubarsky to keep a list of those who are
planning to come. That way we can know the room will
be filled and, if we need a larger room, can request
one as soon as possible. If you plan to come, please

I just want to remind people that hearing
participants need to be very quiet and respectful.
Otherwise, there is a risk that any disturbance will
backfire and antagonize the hearing committee. The
patients who attended my last hearing gave me so much
strength just by being there. I know it wasn't easy
for them to sit there quietly, but they managed to
behave superbly, and I know that helps my case.

So far it seems that the hearing committee is fair.
Our quarrel is not with them. Our quarrel is with
Yale and the IDSA and other establishment critics of
ILADS doctors. So my hearing would not be the
appropriate place for Lyme patients to make their
anger known.

Please continue to look for posts from Ellen Lubarsky
about my case.

As with the Burrascano case, I realize that many
Lyme disease patients will want to rally for their
rights and let those involved with public policy know
that real people are being hurt by the shortage of
health care for patients with chronic Lyme
disease--rights that I realize are very
important. However, to avoid antagonizing the
medical board, I am just asking that you not do this
at my hearing.

le Dr Jones et LE pédiatre llmd au monde!! (c'est lui qui soigne mon fils)
un peu comme Burrascano pour les adultes...(ils se soutiennent d'ailleurs l'un et l'autre)

Compte tenu des délais d'attente (de 6 mois) pour avoir un RDV avec lui et de l'éloignement de la plupart de ses petits patients, Dr Jones (grâce à son expérience en la matière, il en est à 8500 enfants soignés pour lyme dans sa carrière) prescrit parfois à l'issue d'une première consultatiuon téléphonique, des abx à commencer avant le 1er RDV physique avec lui lorsque les enfants vont très très mal (toujours dans cette optique de non assisatnce de personne en danger..)
Pour mon fils il ne l'a pas fait car ce n'était pas un cas extrême. Il lui a prescrit un traitrement après une consultation de 2 heures...

bref, c'est illégal de prescrire un traitement avant d'avoir vu le patient, il a été dénoncé et est attaqué par le Dr Shapiro de Yale, un acharné contre les llmd qui a assigné le Dr Jemsek en justice également.
cet enfoiré (désolé il n'y a pas d'autre mot) veut la peau de tous les llmd américains.(il a dit qu'il abandonnerait les charges si Dr Jones acceptait d'arrêter d'exercer la médecine!!)

Toutefois, comme dans le cas de Burrascano il y a quelques années, durant le procès on s'apperçoit qu'il s'agit de querelles de scientifiques...

La première audience a eu lieu, ça c'est très bien passé et là il va y avaoir la deuxième.
Dr Jones est plutôt confiant . Toute la communauté internationale de lyme s'est mobilisée (dont certains ici! :merci ) pour collecter des fonds pour la défense du dr jones car la facture d'avocat va s'élever a $22 000 tout de même (non pris en charge par les assurances). C'est un médecin qui n'a pas un sou de côté, il vit chichement et met tout son argent dans une fondation qui sert à payer les médicaments et les tests pour les enfants lymés des 4 coins du monde qui viennent le voir et dont les parents n'ont pas les moyens de payer la consultation, les médicaments et tout et tout.)

C'est un saint homme!
Si vous voulez donner un peu d'argent n'hésitez pas!

Dear Friends,

Urgent! I must raise $90,000 by July 14, 2008 and an additional $110,000 by August 10 in order to retain the legal team which has been representing me. If these sums are not raised, I will not be able to continue defending the charges brought against me by the Connecticut Department of Public Health for my treatment of children with Lyme disease, and I fear that I will be forced by the Connecticut Medical Examining Board to resign my license to practice medicine and to retire. This must not happen!

I understand all too well the considerable hardship that Lyme disease has imposed on too many families, and regret the need to appeal to you yet again for donations to my legal defense fund. Yet the prospect of surrendering this critical fight is more daunting: If I do not continue to oppose these charges, how many more physicians will be left vulnerable to similar charges for their treatment of Lyme disease? How many more sick children will be abandoned?

I recognize that the figure of $200,000 appears overwhelming. However:
